Thomas, a yeoman of Westhoughton, left a will written in 1709:
Will
of Thomas Shawe of Westhoughton, 1709
In the name of God Amen I Thomas Shawe of
Westhoughton in the County of Lancaster yeoman doe
make this my last will and testament in manner & forme
following (that is to say) first my mind & testament
shall bee Paid and discharged forth & out of the whole
of my goods and psonall estate. And after the same shall bee
soe paid and discharged as aforesaid then I give and
bequeath unto Anne my wife the summe of twenty pounds
pursuant to the agreement made betwixt mee and her
immediately before our intermarriage and in full of what she
can or may clayme forth & out of my reall and psonall
estate whatsoever. Item I give and bequeath unto Mary
Turton all my goods now standing and being in her now
dwelling house scituate in Westhoughton aforesaid. Item I
give & bequeath unto my son James Shawe one
dwelling and alsoe all my pare trees now growing & being
upon my tenement in Westhoughton aforesaid and alsoe all my
stone trenchs standing and being in and about my now
dwelling house scituate in Westhoughton aforesaid. Item I
give and bequeath unto my said son James Shawe and
unto James Marsh of Westhoughton aforesaid the summe
of thirty shillings to bee by them distributed att their
discressions amongst the poore pepals inhabitting within
Westhoughton aforesaid. I give and bequeath all the rest
residue & remainder of my said goods and psonall estate
unto John Shawe and Raph Shawe my two younger sons
equally to bee devided between them share and share alike.
Wheareas I the said Thomas Shawe in and by one indenture of
assignment bearing date the three and twentieth day of this
instant December, and made between mee the said Thomas Shawe
upon the one part and Henry Hampson of Westhoughton in the
said county yeoman and Robert Leigh of Westhoughton
aforesaid yeoman upon the other part I have libertie and
power to charge all that my messuage and tenement with the
apartences in Westhoughton aforesaid which I hould or lease
under the Right Honorable Richard Lord Viscount Colchester
with any summe or summes of money not exceeding the summe of
thirty pounds of lawfull money of Greate Brinaine to such
uses intents & purposes and in such manner & forme
as I the said Thomas Shawe by any my act or deed or last
will and testament in writing under my hand & seale
lawfully executed & attested in the psence of three or
more witnesses shoud give grant devise charge limit bequeath
or appoint the same now I the said Thomas Shawe in purshange
of my liberty & power aforesaid doe hereby charge the
aforesaid messuage & tenement with the appurtences with
the payment of the summe of thirty pounds of lawfull money
of Greate Britaine in manner and fforme following (that is
to say) with the summe of ten pounds and thereof to bee paid
unto the aforesaid John Shawe and Raph Shawe my two
younger sons equally to bee devided betweene them att
the end of one yeare next after my decease, and with the
like summe of ten pounds another part thereof to bee paid
unto the said Raph Shawe or his assignes att the end of
three yeares next after my decease and to and for noe other
use intent or purpose in any wise whatsoever and I doe
hereby revoke and make void all former and other will and
wills by mee heretofore made. And lastly I doe nominate and
appoint the aforesaid John Shawe and Raph Shawe my said
twoe younger sons executors of this my last will and
testament hopeing they will see the same faithfully pformed
as my trust is in them reposed. In witness whereof I the
said Thomas Shawe have hereunto putt my hand and seale the
six and twentieth day of December Anne RRne Anno Magne
Britaine & Octavo Anno Dom 1709.
