Thomas Henderson was christened 27 December 1652 in Dalkeith, Midlothian, Scotland, the son of John Henderson and Jenet Thomson. He married Agnes Robson. Agnes, or Anna, was christened 25 February 1651 in Dalkeith, the daughter of Alexander Robisson and Alisone Campbell.


Thomas and Agnes had the following children:


1. Isobell, christened 21 June 1668 in Dalkeith.


2. John, christened 1 March 1672 in Dalkeith.


3. Alexander, christened 23 November 1675 in Dalkeith.

John Henderson was born in about 1620 of Dalkeith. He married Jenet Thomson. Jenet was christened 19 September 1624 in Dalkeith, the daughter of James Thomsone and Janet Jamesoune.


John died in about 1665, leaving a testament dative dated 26 January 1666. John's occupation is shown as a baxter (or baker) of Dalkeith. The testament mentioned sons Johne, Thomas and Andro.

In Scottish probate law, real or heritable property was by right inherited by the eldest son, in accordance with Scottish rules of succession. The widow would by right receive one-third of the moveable property as the widow's part, The children would by right receive one-third of the moveable property as the bairn's part. These two-thirds, along with the real property, did not need to be mentioned in a will, as they were a standard part of Scottish inheritance. The deceased could leave the remaining one-third as the deid's part, and stipulate in the will how this would be distributed.

A testament dative is a probate document for a person who died intestate, or without a will. The document names a person to be the executor of the estate. This person may be a close family member or a creditor. For John, the executor was Johne Mitchell, a minister. John Hendersone's three young son were mentioned in the testament dative.

Umpquill (or umqll) is a term meaning deceased in Scottish. A baxter was a baker. A decreet of contitionis causa was the pronouncement of the court as to the amount of a debt to be paid from the deceased's estate. Compeared meant appeared before the court. Bairn is a Scottish term for a child. A compt is an account.
